These Terms & Conditions apply to all bookings and participants joining Mount Rinjani trekking or climbing activities operated by HALOMI TREKKER (“the Operator”). They are drafted to align with commonly accepted travel and adventure tourism standards in the European Union, Australia, and the United States.
1. Contract & Acceptance
- A binding contract is formed once a booking is confirmed and payment is received.
- By participating, the participant confirms they have read, understood, and agreed to these Terms & Conditions.
- These Terms apply to all services provided by HALOMI TREKKER unless otherwise stated in writing.
2. Participant Eligibility
- Participants must be in good physical and mental health and capable of undertaking strenuous, high-altitude trekking.
- Minimum age is 12 years. Participants under 18 must be accompanied by a parent or legal guardian.
- Participation is not recommended for pregnant individuals or persons with serious medical conditions.
3. Health Disclosure & Fitness Declaration
- Participants must disclose any pre-existing medical conditions, allergies, or injuries prior to departure.
- Failure to disclose relevant medical information may result in refusal or termination of participation without refund.
- Participants acknowledge that trekking is physically demanding and accept personal responsibility for their fitness.
4. Assumption of Risk
- Participants acknowledge that adventure travel involves inherent risks, including but not limited to:
- Injury or illness
- Altitude sickness
- Extreme weather conditions
- Volcanic and natural hazards
- Participants voluntarily assume all risks associated with participation, except where liability cannot be excluded under applicable consumer protection laws.
5. Guide Authority & Safety Compliance
- Participants must comply with all instructions given by HALOMI TREKKER guides, staff, and National Park authorities.
- HALOMI TREKKER reserves the right to modify itineraries or remove participants for safety, medical, or behavioral reasons.
- Removal for safety or non-compliance does not entitle the participant to a refund.
6. Environmental & Cultural Responsibility
- Mount Rinjani is a protected National Park. Participants must:
- Carry out all waste
- Avoid damaging flora, fauna, and natural features
- Respect local customs, traditions, and sacred sites
- Violations may result in fines, penalties, or removal from the trek.
7. Weather, Natural Events & Force Majeure
- The Operator is not responsible for delays, changes, or cancellations caused by events beyond reasonable control, including but not limited to:
- Severe weather
- Volcanic activity
- Natural disasters
- Government or park authority restrictions
- In such cases, no guarantee of refund or compensation is provided, except where required by mandatory consumer laws.
8. Accommodation Policy (Room Allocation)
- Accommodation is based on standard twin or double room sharing, with two (2) participants per room.
- For three (3) participants or any uneven number of participants, accommodation will be arranged as one (1) room with an extra bed.
- If participants prefer separate rooms or request an additional room, an extra charge will apply, subject to availability.
- Requests for additional rooms or room upgrades must be made in advance and confirmed in writing.
9. Booking, Cancellation & Refund Policy
- A booking is confirmed once the required deposit payment is received.
- The deposit is normally non-refundable, as it is used to secure Mount Rinjani National Park permits, which are issued by the government.
- In the event of cancellation by the participant for personal reasons, the deposit will be forfeited.
- Cancellations due to force majeure (including but not limited to extreme weather, volcanic activity, natural disasters, or official park closure) may be eligible for a refund only if the Mount Rinjani National Park authority refunds the permit fee.
- Any refundable amount related to park permits will be returned to the participant only after HALOMI TREKKER has received the refund from the park authority. Processing time depends on the government refund procedure.
- Any remaining payments beyond the permit deposit will be handled according to the conditions communicated at the time of booking.
- This policy does not limit any rights that cannot be excluded under applicable EU consumer law, Australian Consumer Law (ACL), or US consumer protection laws.
10. Liability Limitation
- To the maximum extent permitted by law, HALOMI TREKKER is not liable for:
- Personal injury or death
- Loss, theft, or damage to personal property
- Indirect or consequential losses
- Nothing in these Terms excludes rights under EU consumer law, Australian Consumer Law (ACL), or applicable US state laws where such exclusions are not permitted.
11. Insurance Recommendation
- Participants are strongly advised to obtain comprehensive travel insurance.
- Insurance should cover:
- High-altitude trekking and adventure activities
- Medical treatment and evacuation
- Trip cancellation and interruption
12. Photography & Media Use
- HALOMI TREKKER may use photographs or videos taken during the activity for marketing and promotional purposes.
- Participants may opt out by submitting a written request prior to departure.
13. Governing Law & Jurisdiction
- These Terms & Conditions are governed by the laws of the Republic of Indonesia.
- Disputes shall be resolved in Indonesian courts, unless otherwise required by mandatory consumer protection laws of the participant’s country of residence.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
